LATEST: Jury finds Lake Worth man not guilty in rape of teen

A jury found a 26-year-old man not guilty Friday of raping a teen last year.

Andres Pedro Jose, who lived in Lake Worth, was released after the three-day trial on two counts of sexual assault on a minor. Jose had been in jail on $500,000 bail since his arrest in March.

A 16-year-old girl spoke with a Palm Beach County Sheriff’s Office investigator and said she was raped twice by Jose on the same day in December. A month after she told her story to authorities, she found out she was pregnant.

After the teen terminated the pregnancy, investigators sent out DNA from the fetus for a paternity test. According to the sheriff’s office, the paternity test determined there was more than a 99 percent chance that Jose was the father.

In Florida, the age of consent is 18 years old, according to Florida Statutes. People between the ages of 16 and 17 can give consent to a partner up to the age of 23. But anyone 24 years old or older can be charged with a felony if he or she engages in sexual activity with someone younger than 18 years old.

Circuit Judge Joseph Marx presided over the trial.
