A Riviera Beach man is facing attempted murder charges after he allegedly shot another man last month during a drug deal in the parking lot of a Publix Super Market in Boynton Beach, according to a city police report.
Andre Witherspoon, 22, allegedly shot a 39-year-old man in the back as he tried to escape during the Nov. 22 robbery attempt.
Aside from attempted murder, Witherspoon is also facing charges of robbery with a firearm, aggravated assault with a deadly weapon and two probation-violation counts. He is being held in the Palm Beach County Jail without bond.
A man who accompanied the victim told police he arranged with Witherspoon, with whom he had conducted previous drug transactions, to purchase a “sizable amount” of marijuana. They agreed to meet in the Quantum Village plaza on the 1000 block of West Gateway Boulevard, just west of High Ridge Road.
Witherspoon got out of the vehicle he was in and got into the backseat of a Toyota Camry carrying the victim and his friend, the report said.
Witherspoon immediately pulled out a handgun that he was carrying and demanded money from the victim, according to city police. A struggle ensued and the victim ran out of the car before Witherspoon allegedly shot him in the back. Witherspoon then pointed his gun at the victim’s friend before fleeing in a Nissan.
The victim was taken to Delray Medical Center in critical condition, according to the report.
Police say Witherspoon crashed the vehicle he was driving as he tried to escape the parking lot but managed to get away.
The second man in the Camry, who arranged the drug deal, provided police with Witherspoon’s telephone number.
Records show Witherspoon is on probation through March 2019 after his conviction on drug charges. He had been sentenced Sept. 26, according to court records.
