Another potentially multi-million-dollar trial against cigarette-makers is underway in Palm Beach County Circuit Court.
David Cohen is suing R.J. Reynolds, Philip Morris and other tobacco industry giants, claiming they caused the death of his wife, Helen. The Delray Beach woman died in 2006 at age 81 of lung cancer. She had been diagnosed with chronic obstructive pulmonary disease in 1990.
Cohen is one of thousands of people throughout the state who have waited years to have their claims heard.
The Florida Supreme Court in 2006 threw out a $145 billion jury verdict against the tobacco industry.
The court ruled that each person must prove their damages individually. The Cohen case is the fifth to be tried here.
So far, smokers’ families have won two multimillion-dollar verdicts and the tobacco industry has won two.
