NEW: Hugo Selva faced arrest in 2017 before relative declined charges


City police were looking early last year into arresting Hugo Steven Selva for several felonies connected to alleged exploitation of his grandmother until the elderly woman decided not to have her grandson prosecuted, according to a Delray Beach police incident report.

Selva, 22, was killed by a Palm Beach County sheriff’s deputy Wednesday on Interstate 95 near Lantana Road after he fatally shot his 26-year-old girlfriend, Nicole Novak, outside a Lake Worth grocery store, then caused several head-on crashes after driving the wrong way on I-95. Selva and Novak were the parents of a 3-month-old daughter.

Florida Department of Law Enforcement records show that Selva had no criminal record in the state.

Selva was being investigated for grand theft, fraudulent use of a credit card and exploitation of the elderly by Delray Beach police in January 2017 when a detective assigned to the case said Marilyn Selva, Hugo’s 77-year-old grandmother, chose not to press charges against her grandson after obtaining a restraining order against him.

Hugo Selva allegedly forced his grandmother to sign off on a $10,000 line of credit and open a credit-card account with credit limits he regularly exceeded. He needed the money, his grandmother was told, because “he had a child on the way.”

When Selva blew through the card’s $4,500 limit and rang up $6,200 in expenses, he “demanded more money in order to suffice the future child’s needs,” Marilyn Selva told authorities.

If Marilyn Selva balked, her grandson would threaten her, including once with a knife, court documents say.

Hugo Selva also allegedly tried to open up two other credit cards in his grandmother’s name without her permission.

A Delray Beach detective was in the process of obtaining subpoenas for Marilyn Selva’s financial records when she decided not to go forward with the prosecution after a judge ordered that Hugo Selva stay away from his grandmother. The case was then closed.

In February 2017, Marilyn Selva asked that the restraining order be terminated because Hugo Selva had moved out of the area “and has not contacted me since December 2016, and has promised not to contact me or return to my home.”
