A Palm Beach County citrus canker case involving a $19.2 million award to more than 40,000 homeowners whose healthy trees were destroyed is headed for a new trial on the amount of compensation owed.
The Fourth District Court of Appeal said Wednesday there was overwhelming evidence that the state’s destruction of the trees during the citrus canker eradication program constituted a taking. However, Palm Beach County Circuit Court Judge Robin Rosenberg should have allowed scientific evidence in the compensation phase of the case, the court ruled.
