At first, Pierre Fritz Marcelin’s injuries seemed minor. The 56-year-old was disoriented after a forklift accident at Publix Super Markets’ warehouse in Boynton Beach, but he was conscious and not obviously injured.
The night of June 13, Marcelin rounded a corner while driving a forklift. Surprised by a pallet on the floor, Marcelin veered to avoid it, a coworker told police. The longtime Publix employee was thrown from the vehicle, then pinned between the forklift and a column.

Publix’s history of workplace deaths:
April 9, 2007: Truck driver Keith Jackson was crushed to death when he was pinned between his trailer and the loading dock at the Deerfield Beach warehouse. The backup alarm on the machine moving the trailer didn’t work. Publix agreed to pay fines totaling $9,000.
Nov. 10, 2002: Employee at Publix store in Weston slipped for unknown reasons while walking and hit her head on a door. She died of head injuries six days later. OSHA imposed no fines.
July 11, 1999: Deja Brown, a worker at the Publix warehouse in Deerfield Beach, was crushed to death by a tugger while loading a trailer. Publix paid a fine of $7,000.
Sept. 24, 1998: Louis Gallart, a worker at the Publix warehouse in Deerfield Beach, was crushed to death by a tugger while loading a trailer. OSHA imposed no fine.
Jan. 31, 1998: Publix worker Henry Yates died at the Publix warehouse in Deerfield Beach. He was pinned between a hydraulic ramp and the door of a truck trailer. OSHA imposed no fine.
Jan. 15, 1993: Maintenance worker Kevin Miller died after falling while removing light fixtures at Deerfield Beach distribution center. Publix paid a fine of $1,000.
Sept. 23, 1988: Publix worker Juan Ortega lost his leg after using it to try to stop a pallet moving on a conveyor at the Deerfield Beach distribution center. A Jehovah’s Witness, Ortega refused a blood transfusion and died. Publix paid a fine of $350.
